CATH REPORT iOS APP TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of the cathReport mobile application (the "App") operated by Cascade Digital Technologies LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Description of Service
cathReport is a mobile application that allows healthcare professionals to capture, compare, annotate, and share de-identified coronary angiogram images for educational and clinical communication purposes. The App provides tools for image capture, before/after comparison, procedural note-taking, and anonymous sharing via email and text message (MMS).
2. Intended Users
The App is intended for use by licensed healthcare professionals, including physicians, fellows, and other qualified medical personnel involved in percutaneous coronary interventions (PCI). By using the App, you represent that you are a qualified healthcare professional or are using the App under the supervision of one.
3. Not a Medical Device
The App is a communication and documentation tool. It is not a medical device, diagnostic tool, or clinical decision support system. It is not intended to replace clinical judgment, medical records systems, or any established medical workflow. Images and notes created in the App should not be relied upon as the sole record of any medical procedure.
4. No Protected Health Information (PHI)
The App is not designed to store or transmit Protected Health Information as defined by the Health Insurance Portability and Accountability Act (HIPAA). You agree to:
• Not enter patient names, medical record numbers, dates of birth, Social Security numbers, or any other individually identifiable health information.
• Use only de-identified images and non-identifying procedural notes (e.g., patient initials, vessel names, device sizes).
• Comply with your institution's policies regarding the use of mobile devices and image sharing in clinical settings.
You are solely responsible for ensuring compliance with HIPAA and any other applicable privacy regulations. We disclaim all liability for any PHI that is entered into or transmitted through the App in violation of these Terms.
5. Text Messaging Terms and Compliance
Program Name: cathReport PCI Image Sharing
The App allows you to send MMS text messages containing de-identified coronary angiogram images to recipients whose phone numbers you enter. Messages are sent from a toll-free number operated by Cascade Digital Technologies LLC via Twilio. By using the MMS messaging feature, you agree to the following:
• Recipient Consent Required. Before any MMS message can be sent, the recipient must first provide their own explicit consent by completing the online opt-in form at cascadedigitaltechnologiesllc.com/cathreportopt-in. The opt-in form requires the recipient to enter their name and phone number and to affirmatively agree to receive text messages from cathReport. The App automatically verifies that the recipient has an active consent record before allowing a message to be sent. If no consent is on file, you will be prompted to share the opt-in link with the recipient. You may not attempt to bypass the consent verification process.
• Message Frequency. One (1) message is sent per user-initiated send action. cathReport does not send recurring, scheduled, or automated messages.
• Message and Data Rates. Message and data rates may apply to the recipient. Standard carrier fees may be charged.
• Opt-Out. Recipients may opt out of future messages at any time by replying STOP.
• Help. Recipients may reply HELP for assistance, or contact us at owner@cascadedigitaltechnologiesllc.com.
• No Unsolicited Messages. You agree not to use the messaging features to send unsolicited, harassing, or spam messages.
• Legal Compliance. You agree to comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state laws governing electronic communications.
• Shared Infrastructure. Messages are sent from a shared phone number operated by us. We reserve the right to suspend or terminate messaging capabilities if misuse is detected.
• No Guarantee of Delivery. We do not guarantee that messages will be delivered. Delivery depends on carrier support, recipient device capabilities, and network conditions.

6. Temporary Data and Expiration
Certain features of the App involve temporary data storage on our servers:
• Interactive comparison pages expire after 48 hours.
• Uploaded images expire after 48 hours to 7 days, depending on the sharing method.
• Anonymous email aliases expire after 48 hours.
We do not guarantee the availability of shared content for any specific duration. Recipients should download or save shared content before expiration. Expired data is permanently deleted and cannot be recovered.
7. Subscriptions and Payments
The App may offer premium features through in-app subscriptions. Subscriptions are processed and managed by Apple through the App Store. By subscribing, you agree to Apple's terms of service for in-app purchases. Subscription details, including pricing and renewal terms, are displayed in the App before purchase. You can manage or cancel your subscription through your Apple ID settings.
8. Acceptable Use
You agree not to:
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Transmit Protected Health Information or any patient-identifying data through the App.
• Send unsolicited or bulk messages using the App's messaging features.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's backend services or infrastructure.
• Use the App to transmit malicious content, viruses, or harmful code.
• Misrepresent your identity or credentials when using the App.
9. Intellectual Property
The App, including its design, code, features, and documentation, is the property of Cascade Digital Technologies LLC and is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT MESSAGES SENT THROUGH THE APP WILL BE DELIVERED SUCCESSFULLY.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASCADE DIGITAL TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP OR ITS SUBSCRIPTION SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cascade Digital Technologies LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law or regulation, including HIPAA.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App is immediately revoked. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 10, 11, and 12.
14. Modifications to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Washington.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cascade Digital Technologies LLC regarding the use of the App and supersede any prior agreements.
